eGift Card Terms and Conditions

  1. General Terms

    Stage Stores eGift Cards are distributed by CashStar, Inc., a Delaware corporation ("CashStar"). By visiting https://stagestoresgiftcards.cashstar.com, you agree that the laws of the State of Maine, without regard to principles of conflict of laws, will govern these eGift Card terms and conditions ("Ts & Cs"). Specialty Retailers, Inc. ("Stage Stores") and CashStar reserve the right to change these Ts & Cs from time to time in its discretion. Stage Stores eGift Cards are issued by Stage Stores.
  2. eGift Cards

    Stage Stores eGift Cards are redeemable for merchandise at any Bealls, Peebles, Goody's, Palais Royal or Stage locations in the United States, or through any of the Stage Store's websites. Cards not valid at Bealls locations in Florida, Georgia and Arizona.
    Stores operated under the Bealls name located in Arizona, Florida or Georgia are not affiliated with the Stage family of stores and this gift card is not redeemable at any Bealls stores in those states. To locate the Stage store closest to you visit: http://www.stage.com/store/findyourstore.
    Stage Stores eGift Cards are available for purchase here.
    No fees of any kind will be imposed on purchasers or recipients of eGift Cards.
  3. Redemption

    eGift Cards may be used to purchase merchandise only and cannot be redeemed for cash or used for payment on any credit account.
  4. View Your Balance

    To view your Gift Card balance, go to Customer Support or call 1-800-941-4473.
  5. Returns

    You may not return or cancel your Stage Stores eGift Card after it is received. Purchasers who wish to cancel an eGift Card order purchased prior to its delivery to a recipient should contact Customer Support. Merchandise purchased with an eGift Card may be returned for store credit only.
  6. Lost or Stolen eGift Cards

    If you suspect that someone has copied or stolen your eGift Card, contact Customer Support immediately. eGift Cards will not be replaced if lost or stolen, or used without our permission, without proof of purchase. eGift Cards have cash value and should be safeguarded accordingly.
  7. Limitations

    The maximum value that can be associated with any one eGift Card is five hundred dollars ($500.00) and total purchases for any one individual may not exceed ten thousand dollars ($10,000.00) in one calendar day. You may not use an eGift Card to purchase other eGift Cards.
    eGift Cards cannot be reloaded, resold, transferred for value, or redeemed for cash, except to the extent required by law. Void if reloaded, resold, transferred for value, or redeemed for cash. Unused eGift Cards may not be transferred.
  8. Our Policies

    Information that you provide when purchasing an eGift Card is subject to CashStar's Privacy Policy. CashStar and Stage Stores may provide eGift Card purchasers with information about the redemption status of eGift Cards.
  9. Risk of Loss

    Ownership and risk of loss of eGift Cards passes to the purchaser as soon as we send our confirmation to the recipient. We are not responsible for lost or stolen eGift Cards. If you have any questions, please see the FAQs.
  10. Stage Stores eGift Card Customer Service

    If you need assistance with any aspect of your purchase, ownership, or use of your eGift Card, please contact Customer Support. Please refer to your order number, or be ready to supply your email address.
  11. Payment Methods

    Stage Stores eGift Cards may be paid for with a valid VISA, MasterCard, Discover, American Express card, or with PayPal.
  12. Delivery Information and Requirements for eGift Card Purchasers

    All orders of eGift Cards are subject to a process that compares purchaser information provided on the web site with information about the purchaser provided by the purchaser's financial institution. If there is a discrepancy, your eGift Card order may be delayed until it can be corrected.
    If you have concerns about your order, please contact Customer Support. Please refer to your order number, or be ready to supply your email address.
    We are not responsible for eGift Cards that are undeliverable or not received due to your failure to enter an accurate email address for the recipient. Please check to make sure the email address of the recipient is correct and contact Customer Support if you suspect the recipient did not receive his/her eGift Card. Should an email be returned to us due to inaccurate delivery information for the recipient, we will attempt to contact you for a valid email address.
  13. Reasons for Failed Delivery

    eGift Cards are delivered via email. If you have confirmed the recipient's email address but the eGift Card has not been viewed within a reasonable period after the requested delivery date, following is a list of the most common reasons why delivery may have failed:
    1. Spam filter blocked email or routed it to a bulk/spam folder
    2. Recipient's firewall blocked the email
    3. Email inbox is over size limit
    4. Invalid email address
    If a spam filter is blocking stagestoresgiftcards@cashstar.com emails from getting to an inbox, the email options will need to be modified so that stagestoresgiftcards@cashstar.com emails are not considered spam.

  14. Personalized Messaging

    If you wish to add a personal message to an eGift Card, simply type your message in the Message field during the purchase process.
    Personal messages are limited in length to the space provided on the eGift Card, or to the space provided on the presentation carrier of a physical Gift Card.
    There is no additional charge to include a personalized message.
    If we find inappropriate, offensive or otherwise objectionable messages, we reserve the right to cancel them. Thanks for your cooperation.
  15. Limitation of Liability

    STAGE STORES, CASHSTAR AND EACH OF THEIR AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EGIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IF AN EGIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH EGIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
  16. Disputes

    Dispute Resolution. Certain portions of this Section are deemed to be a “written agreement to arbitrate” pursuant to the Federal Arbitration Act. You and Stage Stores agree that we intend that this Section satisfies the “writing” requirement of the Federal Arbitration Act. This Section can only be amended by mutual agreement.

    Binding Arbitration. If any controversy, allegation, or claim relates in any way to your use of the eGift Cards (collectively, “Dispute”), then you agree the Dispute shall be submitted to confidential arbitration in Houston, Texas, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court in the State of Texas. You hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the state and federal courts of Harris County, Texas. Arbitration under these Terms shall be conducted pursuant to the Commercial Arbitration Rules then prevailing at the American Arbitration Association. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of, related to or connected with the use of the eGift Cards must be filed within one (1) year after such claim or cause of action arose or be forever banned.

    No Class Action Matters. Disputes will be arbitrated only on an individual basis and will not be joined or consolidated with any other arbitrations or other proceedings that involve any claim or controversy of any other party. YOU AND STAGE STORES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

    Disclaimer of Representations and Warranties. EGIFT CARDS ARE PROVIDED TO YOU ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. NEITHER STAGE STORES NOR ANY OF ITS OFFICERS, DIRECTORS, MANAGERS, EMPLOYEES OR AGENTS (COLLECTIVELY, THE "STAGE STORES PARTIES") MAKE ANY REPRESENTATIONS, WARRANTIES OR ENDORSEMENTS OF ANY KIND WHATSOEVER AS TO THE CONTENT OR OTHER SERVICES, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, OR ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE, INCLUDING THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND FREEDOM FROM COMPUTER VIRUS. BY ACCESSING OR USING THE SERVICES YOU REPRESENT AND WARRANT THAT YOUR ACTIVITIES ARE LAWFUL IN EVERY JURISDICTION WHERE YOU ACCESS OR USE THE SERVICE.
